Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("you" or "user") and Complifield LLC ("Complifield," "we," "us"). They govern your access to and use of the Complifield website, applications, and services (together, the "Service"). Please read them carefully. By accessing or using the Service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you are using the Service on behalf of a company or other entity, you represent that you have authority to bind that entity, and "you" refers to that entity. If you do not agree to these Terms, do not use the Service.

2. Description of the Service

Complifield provides informational A–F safety grades ("Foremark Scores") for contractors and businesses, derived from public United States Occupational Safety and Health Administration ("OSHA") federal enforcement data. Grades are calculated using a disclosed, weighted methodology — Severity 40%, Frequency 30%, Response time 15%, and Recency 15% — described further on our methodology page. Coverage is limited to certain states and time periods for which we have processed records, and the Service may change, expand, or contract over time.

4. Not a Consumer Reporting Agency; Prohibited Uses

Complifield is not a consumer reporting agency as defined by the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. ("FCRA"). Foremark Scores and the data underlying them are not "consumer reports" and are not intended to be used, in whole or in part, as a factor in establishing an individual's eligibility for any of the following. You agree that you will not use the Service or any grade or data obtained from it for:

You are responsible for compliance with all laws that apply to your use of the Service, including FCRA and its state analogs. If you require FCRA-regulated consumer reports, obtain them from a licensed consumer reporting agency.

5. Data Sources & Accuracy

Grades are derived from public OSHA federal enforcement records — inspections, citations, and penalties. This data:

The Service, including all grades and data, is provided "AS IS" without warranty of accuracy, completeness, currency, or fitness for any purpose.

6. Grade Disputes & Corrections

If you believe a grade or record is inaccurate, outdated, or misattributed, contact us at support@complifield.com with the business name, location, and the specific record at issue. We review such requests in good faith and may correct, annotate, update, or remove information at our discretion. We are not obligated to alter a grade that accurately reflects the public records on which it is based; corrections generally reflect updated public data or methodology changes.

7. Accounts & Registration

Some features require an account, created through email one-time code or a supported single sign-on provider. You agree to provide accurate information, to keep your account access secure, and to be responsible for all activity under your account. You must be at least 18 years old and able to form a binding contract to use the Service.

10. Intellectual Property

The Service, including the Foremark Score methodology, the compilation and presentation of grades, the Complifield name and branding, and all site content, are owned by Complifield or its licensors and are protected by intellectual-property laws. The underlying OSHA records are public; our compilation, scoring, and presentation are not. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your own internal evaluation purposes.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY OF ACCURACY, COMPLETENESS, OR TIMELINESS. WE DO NOT WARRANT THAT GRADES PREDICT FUTURE SAFETY OR PERFORMANCE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPLIFIELD AND ITS OFFICERS, MEMBERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY GRADE OR DATA. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify and hold harmless Complifield from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your use of any grade or data in a manner prohibited by Section 4 or Section 9.

14. Third-Party Services

The Service integrates third-party providers (for example, payment processing and authentication). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination — including Sections 4, 5, 10, 11, 12, 13, and 17 — will survive.

17. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You and Complifield agree to the exclusive jurisdiction and venue of the state and federal courts located in Miami-Dade County, Florida, for any dispute not otherwise subject to an alternative dispute-resolution provision.
